~Horse & Pony Consignment Application~

Below you will find a copy of Cardinal Stables & Riding Academy Consignment Contract. If accepted, you will be required to sign this contract in person. This contract applies to On-Site Consignments and does not apply to our website consignment program.

CONSIGNMENT CONTRACT

1. I certify that I am either the sole owner of the entered horse, or authorized by the owner or co-owners to act as agent in the consignment and sale of the entered horse. I hereby warrant title to each animal herein entered and my authority to enter each such animal in this sale, and I agree to defend and hold Cardinal Stables & Riding Academy harmless regarding said title and authority. I appoint Cardinal Stables & Riding Academy as my agent for sale of the named horse, with full authority to transfer the title thereto and to receive the proceeds of such sale for the account of the owner of the horse.

I covenant and agree to indemnify and hold harmless Cardinal Stables & Riding Academy from any and all costs, liabilities, and expenses (including attorney’s fees) incurred because of, or arising out of, all questions of title to the named horse; and disputes concerning identity, soundness, engagements, pregnancy status and/or produce record of named horse or resulting from any liens, attachments, or claims against the net proceeds from the sale thereof.

1. I agree to a separate boarding contract and agree give absolute right of advertisement and sale to Cardinal Stables. I agree to remove said horse from any other site/paper/etc in which this horse is advertised for sale.

2. I agree to allow Cardinal Stables and their agents to show said horse at their discretion and in a manner they feel most favorable to the sale of said horse. I further agree to allow buyer a ___ week trial of horse.

3. I agree to allow Cardinal Stables & Riding Academy to market said horse at a fair market in which they see fit. I further agree that any moneys over $_________________ shall be payment to Cardinal Stables for acting as the agent of sale of said horse.

4. For all buyers the terms of the sale are cash, or approved check payable the day of sale. Settlement with the consignor will be made on the thirtieth (30th) business day after the last day of the sale, except in such cases where the buyer has defaulted on a payment due. In such cases, settlement with the consignor will not be made until the buyer has completely paid for all purchases, and such payment has been satisfactorily cleared by Cardinal Stables & Riding Academy bank.

5. I authorize the Cardinal Stables & Riding Academy to deliver possession of any horse sold to the buyer. If a check or draft is not honored for any reason, or if payment is stopped, Cardinal Stables & Riding shall not be liable to the consignor. Consignor’s sole remedy shall be against defaulting purchaser.

6. I covenant and agree to indemnify and hold Cardinal Stables & Riding Academy harmless from any and all costs, liabilities, and expenses (including attorneys’ fees)

for any disputes concerning the sale of the named horse, including, but not limited to issues of soundness. The owner is the responsible party for true Representations of animals. Cardinal Stables & Riding Academy is not responsible for any unsoundness/vices/unsuitability whatsoever.

7. I agree that if said horse is not usable in Cardinal Stables & riding Academy Program, I am required to sign a separate boarding contract and agree to pay full boarding fees.
